What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. Landlord served a valid N4 Notice, which Tenants did not void by paying arrears. Tenants were still in possession of the rental unit at the time of the hearing but did not attend.

The ruling

The tenancy is terminated unless Tenants void the order by paying $23,408.80 by January 31, 2023, or $24,417.85 by February 11, 2023. If Tenants do not void the order, they must pay $21,928.19 to the Landlord and vacate the unit by February 11, 2023. Tenants will owe $33.17 per day for use of the unit from January 17, 2023, until they move out.
