What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective October 24, 2017 unless the Tenants pay $3,585.68 to void the eviction order and continue the tenancy. If the Tenants do not make this payment, they must move out by October 24, 2017 and pay the Landlord $1,611.56 plus $37.42 per day from October 14, 2017 until they move out. The Tenants are also ordered to pay the rent on time going forward, or the Landlord can apply to terminate the tenancy.
