What happened
Tenant applied for an order determining that Landlords failed to meet their maintenance obligations under the Residential Tenancies Act, 2006. The Tenant alleged issues with the rental unit including unfinished flooring, holes in walls, lack of insulation and improper separation of units causing noise and temperature issues, lack of cleanliness in common areas, and a continuously running toilet.
The ruling
The Landlords failed to meet their maintenance obligations under the Act. The Tenant is entitled to a rent abatement of $1,056.25 and reimbursement of the $45 application fee, for a total of $1,101.25 owed to the Tenant. The Landlords must complete the required repairs by September 1, 2020 or the Tenant may hire contractors and be reimbursed.
