What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to an illegal act and serious impairment of safety. The Tenant's dog, a Rottweiler, bit the superintendent of the building, causing injuries that required hospital treatment.
The ruling
The tenancy shall continue subject to the condition that the Tenant, any guest or occupant shall exercise reasonable precautions to prevent any dogs owned by the Tenant or permitted at the rental unit or residential complex by the Tenant from biting or attacking a person or domestic animal or behaving in a manner that impairs the safety of persons or animals. If the Tenant does not comply with this condition, the Landlord may apply for an order terminating the tenancy and evicting the Tenant. The Tenant shall also pay the Landlord $190 for the cost of filing the application.
