What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
The ruling
The Tenant is ordered to pay the Landlord $1,762.77, which represents the rent arrears and application fee, less the $370 rent abatement awarded to the Tenant. If the Tenant does not pay the full amount by March 27, 2017, the Tenant will start to owe interest. The Landlord is ordered to inspect and repair the intercom, re-grout the bathroom tiles, and repair or replace the bathroom trim by April 28, 2017. If the Landlord fails to comply, the Tenant is authorized to deduct 5% of the monthly rent starting May 1, 2017.
