What happened

Landlords applied to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant was incarcerated since January 2021 and was not aware of the hearing until her release. Tenant is willing to pay a portion of her Ontario Works allowance towards the arrears.

The ruling

The Landlord's application for eviction is denied on the condition that the Tenant pays the outstanding $883 in arrears and costs through a payment plan, pays the May 2021 rent in full, and authorizes Ontario Works to pay the rent allowance directly to the Landlord by May 31, 2021. If the Tenant fails to meet these conditions, the Landlord may apply for an eviction order.
