What happened

Landlords applied for an order to terminate the tenancy and evict the Tenant because the Landlords require possession of the rental unit for the purpose of residential occupation by the Landlords' child. The application was dismissed due to a fatal defect in the N12 notice of termination.

The ruling

The Landlords' application is dismissed, without prejudice. The Tenant shall pay to the Landlords $1,200.00, which was given by the Landlords in the form of a rent abatement for the month of June 2021 as the required compensation under s. 48.1.
