What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant causing a cooking fire and dismantling the smoke alarm, which seriously impaired the safety of other tenants in the residential complex.

The ruling

The Landlord's application for eviction of the Tenant is denied on the condition that during the one-year period from October 14, 2021 to October 13, 2022 the Tenant shall not cause a fire in the rental unit or anywhere in the residential complex at 17 McCormack Street, and shall not tamper with any smoke alarm in the rental unit. If the Tenant fails to comply with these conditions, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 for an order terminating the tenancy and evicting the Tenant.
