What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The first named Tenant, Cassandra Crocker, remained in possession of the rental unit at the time of the hearing, while the second named Tenant, Justin Gallant, had vacated the unit on December 1, 2020.

The ruling

The tenancy is terminated unless the Tenant pays $14,206 by February 28, 2023 to void the order and continue the tenancy. If the Tenant does not void the order, they must pay $10,057.50 to the Landlord and vacate the unit by February 28, 2023. The Tenant will also owe daily compensation of $55.89 starting January 19, 2023 until they vacate.
