What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had attempted to attend the hearing but was unable to participate due to technological issues.

The ruling

The tenancy is terminated effective December 31, 2022 unless the Tenant pays $5,095 by November 30, 2022 or $6,270 by December 31, 2022 to void the order and continue the tenancy. If the Tenant does not void the order, they must pay $2,601.42 to the Landlord and will owe daily compensation of $38.63 per day starting October 28, 2022 until they move out.
