What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was not present at the hearing.
The ruling
The tenancy is terminated effective July 15, 2021. The tenant must move out by that date. The amount of the rent deposit and interest the landlord owes the tenant exceeds the arrears and compensation the landlord is entitled to by $551.31. The landlord is authorized to offset $42.14 per day for compensation for use of the unit starting June 22, 2021 and $186 for the application filing fee. The tenant can void the order by paying $1,437.32 by June 30, 2021 or $2,719.08 by July 15, 2021.
