What happened

Landlord applied for an order to terminate the tenancy of Tenant Hussein Said and for compensation for the use of the rental unit by the Unauthorized Occupant Aden Farah. The Tenant had moved out of the unit on or about June 30, 2020, and the Landlord became aware that Aden Farah remained in possession of the unit without the Landlord's consent.

The ruling

The tenancy between the Landlord and Tenant is terminated as of June 30, 2020, the date the Tenant moved out of the rental unit. The Unauthorized Occupant Aden Farah is ordered to move out of the rental unit by December 31, 2021, and to pay the Landlord $34.68 per day for compensation for the use of the unit from July 1, 2020 to the date they move out. If the Unauthorized Occupant does not pay the full amount owing by December 31, 2021, they will owe interest at 2.00% on the outstanding balance starting January 1, 2022.
