What happened
Landlords applied for an order to terminate the tenancy and evict the Tenant because the Tenant entered into an agreement to terminate the tenancy. The Tenant filed a motion to set aside the previous order.
The ruling
The previous eviction order was set aside, and the Landlord's application was dismissed. The N11 agreements to terminate the tenancy were found to be invalid, as they were entered into at the inception of the tenancy, in contravention of the Residential Tenancies Act.
