What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears. The Tenant had not paid the full rent for the period from August 1, 2021 to November 30, 2021.

The ruling

The tenancy is terminated effective January 22, 2022. The Tenant must pay the Landlord $339.94, which includes rent arrears and compensation, plus $3.78 per day for use of the unit starting January 12, 2022 until the Tenant moves out. The Tenant must also pay the $186.00 application fee. If the Tenant pays $596.00 on or before January 22, 2022, the eviction order will be void and the tenancy will continue.
