What happened
Tenant applied for an order determining that Landlord failed to meet maintenance obligations under the Residential Tenancies Act, 2006 with respect to repairing her toilet in the rental unit. The Landlord's Legal Representative requested the Board amend the application to reflect the Landlord as being 'Multi-Res Income Partners, GP, 1' only and that 'Chris Lee' is not the Landlord and should be removed as a named Landlord in the application.
The ruling
The Tenant's application is dismissed. The Landlord responded reasonably in the circumstances and in a timely manner to the Tenant's requests for maintenance of her toilet. The Landlord did not breach subsection 20(1) of the Act by failing to maintain the rental unit with respect to the toilet.
