What happened
Landlord applied to terminate the tenancy and evict Tenant due to non-payment of rent. Landlord also applied to terminate the tenancy based on an agreement to terminate the tenancy, but the evidence did not support this.
The ruling
The tenancy is terminated effective August 19, 2013. The Tenant must pay the Landlord $3,593.39, which includes rent arrears and compensation up to August 8, 2013, plus $49.32 per day for compensation for use of the unit starting August 9, 2013 until the Tenant moves out. If the Tenant pays $4,670.00 to the Landlord or the Board by August 19, 2013, the eviction order will be void and the Tenant can remain in the unit.
