What happened

Landlords applied for an order to terminate the tenancy and evict Tenant because they required possession of the rental unit for personal use. The application was dismissed due to an invalid N12 notice and failure to pay compensation to the Tenant.

The ruling

The Landlords' application for termination of tenancy and eviction was dismissed. The N12 notice was found to be invalid as it did not identify the municipality of the rental unit. Additionally, the Landlords failed to pay the required compensation to the Tenant as per Section 55(1) of the Residential Tenancies Act, 2006.
