What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was not present at the hearing despite being served with notice.

The ruling

The tenancy is terminated unless the Tenant voids the order by paying $755.23 by January 31, 2023, or $2,324.02 by February 7, 2023. If the Tenant does not pay, they must move out by February 7, 2023. The Landlord owes the Tenant $1,521.07 from the rent deposit and interest, but can deduct $51.58 per day for compensation until the Tenant moves out.
