What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was not present at the hearing.

The ruling

The tenancy is terminated effective August 1, 2021. The Tenant must move out of the rental unit on or before August 1, 2021. The Landlord is authorized to offset compensation for the Tenant's use of the unit starting July 22, 2021 and the cost of filing the application from the amount the Landlord owes the Tenant for the rent deposit and interest. If the Tenant wishes to void the order and continue the tenancy, the Tenant must pay $2,384.69 by July 31, 2021 or $4,428.69 by August 1, 2021.
