What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears. The Tenant was in possession of the rental unit on the application date.

The ruling

The tenancy is terminated effective March 31, 2022. The Tenant must move out of the rental unit by this date. The amount of the rent deposit and interest the Landlord owes on the rent deposit exceeds the arrears of rent and compensation the Landlord is entitled to by $153.97. The Landlord is authorized to offset $39.89 per day for compensation for the use of the unit starting February 19, 2022 to the date the Tenant moves out, and $186.00 for the cost of filing the application. If the unit is not vacated by March 31, 2022, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The Tenant can void the order and continue the tenancy by paying $1,686.13 on or before February 28, 2022, or $2,899.46 on or before March 31, 2022.
