What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were in possession of the rental unit as of the hearing date.

The ruling

The tenancy is terminated effective June 28, 2021. The Tenants must pay the Landlord $10,552.62 (less any payments made after September 18, 2020), plus $32.37 per day starting June 18, 2021 until they vacate the unit. If the Tenants pay $12,177.07 (less any payments made after September 18, 2020) by June 28, 2021, the eviction order will be void and the Tenants can remain in the unit.
