What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to the Tenants substantially interfering with the Landlord's lawful right, privilege or interest. The Landlord served the Tenants with two N5 Notices of Termination due to the rental unit not being in a reasonable state of cleanliness and the Tenants leaving a garbage bag containing feces in the lobby.

The ruling

The tenancy between the Landlord and Tenants is terminated. The Tenants must move out of the rental unit on or before May 8, 2021. The Tenants shall pay the Landlord $190 for the cost of filing the application. The Board is directed to pay the Landlord $58 for the cost of filing the request to review. Eviction by the Sheriff may occur after the regulation prohibiting evictions during the pandemic is removed by the Ontario Government.
