What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not paid the full rent from April 1, 2020 to December 31, 2020.

The ruling

The tenancy is terminated effective January 22, 2021 unless the Tenant pays $5,212 to void the eviction order. The Tenant must pay $3,657.79 to the Landlord, plus $28.56 per day starting January 12, 2021 until the unit is vacated.
