What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant and unauthorized occupant due to non-payment of rent and unauthorized occupancy. The Tenant acknowledged she no longer resided in the rental unit, and the unauthorized occupant, Mark Lukacko, acknowledged living in the unit since the Tenant vacated. Rent had not been paid since May 2020, totaling $43,120.

The ruling

The tenancy between the Landlord and Tenant is terminated as of March 5, 2022. The unauthorized occupant shall move out of the rental unit on or before March 5, 2022 and pay the Landlord $35,000 as compensation for use of the unit. If the unit is not vacated by March 5, 2022, the Landlord may file the order with the Court Enforcement Office for enforcement.
