What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. One tenant had vacated the unit in January 2021, while the other tenant's possessions remained in the unit.

The ruling

The tenancy is terminated effective June 28, 2021. The Tenants must pay the Landlord $7,320.32, which includes rent arrears, compensation, and application fees, less the rent deposit and interest owed on the deposit. The Tenants must also pay $43.38 per day for each day of occupation starting June 18, 2021 until they vacate the unit. If the Tenants pay $8,940.45 on or before June 28, 2021, the eviction order will be void and the tenancy will continue.
