Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord served a valid N8 notice on the Tenant with a termination date of November 30, 2021.
The ruling
The tenancy is terminated effective November 30, 2021. The Tenant must move out by March 31, 2022 and pay the Landlord $3,099.05, which includes compensation for use of the unit from December 1, 2021 to February 28, 2022, less the rent deposit and interest owed on the deposit. The Tenant must also pay the Landlord $56.59 per day from March 1, 2022 until the Tenant moves out, as well as the $186 application filing fee. If the Tenant does not pay the full amount by March 31, 2022, they will owe interest at 2% annually on the outstanding balance.
