What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid the full rent from December 1, 2019 to October 31, 2020.

The ruling

The tenancy is terminated effective November 5, 2020. The Tenants must pay the Landlords $20,698.85, which includes rent arrears up to October 29, 2020 and the cost of filing the application, minus the rent deposit and interest on the deposit. The Tenants must also pay $75.45 per day for compensation for use of the unit starting October 30, 2020 until they move out. If the Tenants wish to void the order and continue the tenancy, they must pay $23,235.00 by October 31, 2020 or $25,530.00 by November 5, 2020.
