What happened

Landlords applied for an order to terminate the tenancy and evict Tenants because the Landlords require possession of the rental unit for the purpose of residential occupation. The application was based on an N12 Notice indicating both the Landlords' child and parent intend to move into the rental unit and occupy it for at least one year.

The ruling

The Landlords' application for termination of tenancy and eviction of Tenants for personal use was dismissed. The Landlords failed to satisfy the Act's requirements by not providing a declaration from the person who requires the unit and not paying the required compensation to the Tenants.
