What happened
Landlords applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The tenancy was initially between the Landlords and the corporate Tenant, Executive Stay Inc. When the tenancy was renewed, the lease form changed to include the principal of the corporation, Ashish Chhibber, as a Tenant. However, the Landlord communicated primarily with the employees of Executive Stay Inc. and the nature of the tenancy was found to be commercial, not residential.
The ruling
The Landlord's application is dismissed. The Residential Tenancies Act, 2006 does not apply to this tenancy, as it was found to be for commercial purposes and not residential.
