What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord served an N8 notice on September 2, 2021, after the Tenant consistently paid rent late from September 2020 to October 2021. The Tenant improved payment timeliness for two months but was late again in January.

The ruling

The Board issued a conditional order allowing the tenancy to continue, provided the Tenant pays rent on time for the next 12 months (March 2022 to February 2023). The Tenant must also pay the $186 application fee by February 27, 2022. If the Tenant breaches these conditions, the Landlord may apply for termination and eviction within 30 days of the breach.
