What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The application was filed after serving a valid N8 Notice of Termination for Persistent Late Payment of Rent, which the tenants did not void by paying the rent on time.
The ruling
The tenancy between the Landlord and the Tenants continues if the Tenants pay the rent on time for a 12-month period. The Tenants shall pay the September 2023 rent by September 15, 2023 and the monthly rent on or before the first day of each month from October 2023 to August 2024. If the Tenants fail to comply, the Landlord may apply for an order terminating the tenancy and evicting the Tenants. The Tenants shall also pay the Landlord $186.00 for the cost of filing the application.
