What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord served a valid N8 Notice to End Tenancy for Persistent Late Payment of Rent, but the Tenants did not attend the hearing.
The ruling
The tenancy is terminated effective February 19, 2022. The Tenants must vacate the unit by that date and pay the Landlord $9,092.16, which includes compensation for use of the unit from June 2021 to February 2022, less the rent deposit. The Tenants must also pay $40.85 per day from February 9, 2022 until they vacate, as well as the $186 application fee. If the Tenants do not pay the full amount by February 19, 2022, they will owe interest at 2% annually on the outstanding balance.
