What happened
The landlord applied for an order to terminate the tenancy and evict the tenant because the parties signed an N11 agreement to terminate the tenancy. The tenant alleged that she was misled to sign the N11 agreement under false pretenses, as she is a vulnerable, elderly woman. The Board found that the N11 agreement did not properly identify the rental unit, and therefore set aside the previous eviction order.
The ruling
The Board set aside the previous eviction order and dismissed the landlord's application, finding that the N11 agreement to terminate the tenancy was invalid because it did not properly identify the tenant's rental unit.
