What happened
Landlord applied for an order to terminate the tenancy and evict Tenants based on a notice to terminate given by the Tenants. Tenants filed a motion to set aside the previous order. The Board found that the notice of termination was defective as it was not signed by all parties to the tenancy agreement and did not provide sufficient notice as per the Residential Tenancies Act.
The ruling
The Tenants' motion to set aside the previous order is granted. The Landlord's application is dismissed. The Board found that the notice of termination provided by the Tenants was defective as it was not signed by all parties to the tenancy agreement and did not provide sufficient notice as required by the Residential Tenancies Act.
