What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit prior to the hearing date.

The ruling

The tenancy is terminated effective January 8, 2021. The tenants must pay the landlord $12,728.63, which represents the rent arrears and compensation up to December 28, 2020, plus $27.95 per day for compensation for the use of the unit starting December 29, 2020 until the date the tenants move out. If the tenants do not pay the full amount owing by January 8, 2021, they will start to owe interest at 2% annually on the outstanding balance. If the unit is not vacated by January 8, 2021, the landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The tenants can void the order and continue the tenancy by paying $12,750 by December 31, 2020 or $13,600 by January 8, 2021.
