What happened

Landlord applied for an order to determine whether the Residential Tenancies Act, 2006 applies to the rental unit. The Tenant lives with the Landlord's son, Brandon Myers, who was not served as an affected party.

The ruling

The Residential Tenancies Act does not apply to the rental unit. There was no intent to establish a landlord-tenant relationship, and the payments made were only to cover the cost of hydro.
