What happened

Tenant applied for an order determining that the Landlord collected or retained money illegally. The Tenant alleged that the Landlord failed to disclose that other rooms in the lower unit would be rented out to other Tenants, and that the Tenant believed she would only be occupying the house with the Landlord. The Tenant asserted that had this fact been disclosed, she would not have moved into the rental unit. The Landlord disputed the Tenant's assertion, stating that the Tenant simply rented a room from the Landlord, not the whole lower unit.

The ruling

The Tenant's application is dismissed. The Landlord is entitled to keep the Tenant's deposit and apply it to any outstanding balance that would be owing to the Landlord.
