What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the tenant did not void by paying the arrears. The tenant was not present at the hearing.
The ruling
The tenancy is terminated effective February 5, 2021. The tenant must pay the landlord $15,811.51 (less any payment made after September 18, 2020), which includes rent arrears, compensation, and application filing costs, less the rent deposit and interest owed on the deposit. The tenant must also pay $40.44 per day for use of the unit starting January 26, 2021 until move-out. If the full amount is not paid by February 5, 2021, the tenant will owe interest and the landlord can file the order for enforcement.
