What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant makes the following payments to the Landlord: $398.75 by August 20, 2021, $398.75 by September 20, 2021, $398.75 by October 20, 2021, and $398.75 by November 20, 2021. The Tenant shall also pay the August 2021 rent by August 15, 2021 and the rent for September to November 2021 by the first day of each corresponding month. If the Tenant fails to make any of the payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and the balance owing shall become payable with interest.
