What happened
Tenant applied for an order determining that the Landlords gave a notice of termination in bad faith. The Tenant vacated the unit in December 2015 after receiving an N12 notice, but later saw the unit was vacant and advertised for rent. The Landlords claimed they intended for the Landlord's son to occupy the unit, but he later decided not to.
The ruling
The application is dismissed. The Landlords' notice of termination was given in good faith at the time it was served, even though the Landlord's son later decided not to occupy the unit.
