What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. Leeanne E. Mckend vacated the unit before the filing of the Landlord's application.

The ruling

The tenancy is terminated effective March 2, 2021. The Tenant must pay the Landlords $26,874.68, plus $105.21 per day starting February 20, 2021 until the Tenant vacates the unit. If the Tenant does not pay the full amount owing by March 2, 2021, the Tenant will start to owe interest at 2.00% annually on the balance outstanding. If the unit is not vacated by March 2, 2021, the Landlords may file the order with the Court Enforcement Office (Sheriff) for eviction. The Tenant can void the order and continue the tenancy by paying $31,186.00 on or before February 28, 2021, or $34,386.00 on or before March 2, 2021.
