What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent from January 2020 to September 2021. The Landlord served an N8 Notice of Termination on November 19, 2021. The Tenant continued to pay rent late after the notice but has recently paid rent up to February 28, 2022.
The ruling
The Board issued a conditional order allowing the tenancy to continue, provided the Tenant pays rent in full and on time for the next 12 months (March 2022 to February 2023). If the Tenant fails to make any payment on time, the Landlord may apply for termination and eviction within 30 days of the breach. The Tenant must also pay the Landlord $186.00 for the application filing cost by March 31, 2022.
