What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant did not attend the hearing. Landlord served a valid N4 Notice, which Tenant did not void by paying arrears. As of the hearing date, Tenant had paid all rent arrears, leaving only the application filing fee outstanding.

The ruling

The Tenant is ordered to pay the Landlord $186.00 for the application filing fee. If not paid by November 9, 2022, interest will start accruing at 4.00% annually from November 10, 2022. The Board considered all circumstances and found it would not be unfair to grant relief from eviction as the Tenant had paid all rent arrears by the hearing date.
