What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit on September 8, 2022, prior to the hearing date.

The ruling

The tenancy was terminated effective December 12, 2021. The Tenant is ordered to pay $13,982.50 to the Landlord, which includes rent arrears up to December 1, 2021 and the cost of filing the application, less the rent deposit and interest on the deposit. If the Tenant pays $16,482.00 on or before December 12, 2021, the eviction order will be void and the tenancy will continue.
