What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit at the time of the hearing.
The ruling
The tenancy is terminated effective January 24, 2021, unless the tenant pays $12,766.48 to the landlord or to the Board in trust by that date to void the eviction order. If the tenant does not make this payment, the landlord may file the order with the Court Enforcement Office for enforcement. The tenant also owes the landlord $10,354.92 in rent arrears and compensation, less the rent deposit and interest, and $175 in application filing fees. If the unit is not vacated by January 24, 2021, the tenant will owe the landlord $44.92 per day in compensation starting January 14, 2021.
