What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The tenancy is terminated effective October 17, 2021, unless the Tenants pay $16,596 to void the order and continue the tenancy. The Tenants must pay the Landlords $15,019.59 for rent arrears, NSF cheque charges, and application filing fees, plus $59.18 per day starting October 7, 2021 until they vacate the unit. If the Tenants do not pay the full amount by October 17, 2021, the Landlords may file the order with the Sheriff to enforce the eviction.
