What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The ruling

The tenancy is terminated effective November 3, 2020. The Tenants must move out by that date. The Landlord owes the Tenants $1,813.43 from the rent deposit and interest, but the Landlord can offset $46.87 per day for compensation starting October 24, 2020 and $175 for the application fee. If the Tenants pay $400.82 by October 31, 2020 or $1,830.42 by November 3, 2020, they can void the eviction order and continue the tenancy.
