What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Landlord served a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears.

The ruling

The tenancy between the Landlord and the Tenant is terminated. The Tenant moved out of the rental unit on or before November 30, 2019. The Tenant shall pay to the Landlord $10,374.35, which represents the amount of rent owing and compensation up to November 30, 2019, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant shall also pay to the Landlord $190.00 for the cost of filing the application. If the Tenant does not pay the Landlord the full amount owing on or before June 11, 2021, the Tenant will start to owe interest at 2.00% annually on the balance outstanding. The Board shall pay to the Landlord the amount of $1,510.00 together with any accrued interest. The Tenant's claim under section 82 of the Act is dismissed.
