What happened
Landlord applied to terminate the tenancy and evict the Tenant because the Tenant failed to meet a condition specified in the consent order issued by the Board on August 18, 2021 with respect to application TEL-15912-21. The Tenant had failed to declutter and clean the unit to address the concerns in the N5 Notice of Termination on or by September 15, 2021.
The ruling
The tenancy is terminated effective October 30, 2021. The Tenant owes no money to the Landlord because the amount of the rent deposit and interest the Landlord owes on the rent deposit creates a credit owed to the Tenant of $1,203.10. The Landlord is authorized to offset any daily compensation owed by the Tenant by the amount of the credit until the Tenant moves out.
