What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The Tenant shall pay the Landlord $5,463.50 for arrears of rent up to June 30, 2022 and costs, in accordance with a payment schedule. The Tenant shall also pay new rent on time and in full as it comes due and owing for the period July 1, 2022 to February 1, 2023, or until the arrears are paid in full, whichever date is earliest. If the Tenant fails to make any one of the payments, the outstanding balance shall become immediately due and owing and the Landlord may apply to the LTB for an order terminating the tenancy and evicting the Tenant.
